D-Side Travel LLC Terms & Conditions
Please read these terms and conditions carefully prior to submitting payment. By signing these Terms
and Conditions, and paying your deposit you agree and consent to each and all of these Terms and
Conditions. These Terms and Conditions apply to all services provided by D-Side Travel LLC. Hereafter
known as “D-Side Travel”.
A. LIMITED PRINCIPAL AND AGENT AGREEMENT
These Terms and Conditions establish a relationship of principal and agent between you, as principal; and
D-Side Travel as agent; however D-Side Travel’s duty to you as principal is solely with respect to booking
travel and there is NO OTHER DUTY, fiduciary or otherwise owed by D-Side Travel, including, without
limitation, a duty to warn of dangers (hidden or otherwise) with respect to any activity undertaken by you
with respect to such travel. YOU HEREBY ASSUME THE RISK OF DEATH, accident, property damage and
PERSONAL INJURY with respect to any such activity. As your agent, D-Side Travel acts pursuant to your
authority and may bind you only to the extent of such authority. By these Terms and Conditions you grant
D-Side Travel such express authorization for the purpose of booking travel.
D-Side Travel, its employees, officers, successors, agents and owner does not own or operate any lodges,
hotels or entity which is to or does provide goods or services for your trip. D-Side Travel purchases
transportation, accommodation, and all ground handling from various independent suppliers and DMC.
All such entities are independent contractors. D-Side Travel, their agents and officers and/or suppliers of
services pursuant to or in connection with these itineraries, shall act only as agent for the clients in making
arrangements for hotels, transportation, restaurants, or any other service and do not assume any liability
whatsoever for any injury, damage, death, loss, accident or delay to person or property due to an act of
default of any hotel, carrier, restaurant, company or person rendering any of the services included in these
tours, or by force majeure. Further, no responsibilities are accepted for any damage or delay due to
sickness, pilferage, labor disputes, mechanical breakdown, quarantine, government restraints, weather
or other causes beyond their control. No responsibility is accepted for any additional expenses, omissions,
delays, rerouting or events resulting from improper health certificates or documents or acts of any
government or authority
B. COST INCLUSIONS
Personalized itinerary planning and destination research by D-Side Travel; all accommodations, including
hotel taxes and service charges; regional air and surface transportation as quoted; privately guided
sightseeing conducted by local, English-speaking guides; shared game drives unless otherwise specified;
meals as indicated in day-by-day itinerary; airport transfers; admission fees as indicated; the full services
of D-Side Travel and our associate offices overseas before, during, and after traveling; pre-trip travel
document packet or e-documents. Fuel surcharges and Park Fee increases are not included if levied after
the date of the quote.
All tour costs are based on the services specified in each tour’s detailed itinerary. Services are
sold as a complete package and D-Side Travel will not provide a breakdown of trip component
costs. All costs quoted are based on availability and subject to change. When included, airfare,
airport taxes and VAT are current and subject to change without warning until date of
departure. As airlines can unexpectedly impose rate increases: airfare may increase between
time of booking/payment and issuing of ticket due to fuel surcharges and other fees imposed at
the discretion of the airlines. All pricing is indicative and subject to exchange rate fluctuations.
D. PAYMENT SCHEDULE
A 20%- 30% deposit per person is required to confirm all services (depending on the season and lodge
policy). Final payment is due 90 days prior to international departure. Payment may be made by personal
check, travel agency check, wire transfer or credit card (American Express, Visa, MasterCard). There may
be some services on a booking which require full payment at time of confirmation. These include, but are
not limited to, scheduled flights, Festive Season deposits and extraordinary property deposits. These are
payable on receipt of a quote, and these deposit payments are over and above the cancellation policy
stated below. No refund will be made for no-shows or unused services whilst travel is under way. We are
liable for deposits to suppliers from the moment you confirm your trip with D-side Travel. Cancellations
charges will apply once a trip has been confirmed.
Credit card transactions are administered by a third-party service provider. You accept and consent to
your personal data being provided to the third-party service provider for sole purpose of offering and
administering the credit card transaction.
ALL BOOKING CANCELLATIONS, REVISIONS, AND CHANGES ARE SUBJECT TO TERMS AND LIMITATIONS.
Cancellations are subject to the following penalties of the full tour price:
20% or 30% Deposit Liability on confirmation of services
90-61 Days prior to departure 50%
60 Days prior to departure 100%
F. PASSPORTS & VISAS
You acknowledge that you are solely responsible for ensuring that you meet foreign entry requirements
and that your travel documents, such as passports and visas, are in order. A valid passport is required for
U.S. citizens traveling outside of the U.S. Passports must be valid for six (6) months after the return of your
journey as well as have sufficient blank passport pages for entry and exit stamps. Travelers are advised to
consult with their appropriate government authority to determine any necessary documents, allowances
and requirements for travel to their intended destination. Unless otherwise specified, D-Side Travel trips
do not include visa authorization and processing fees. If requested, we can provide invitation letters to
obtain visas in advance. In some countries, visas can only be obtained upon arrival, in which case the fee
cannot be pre-paid and clients will be required to pay it directly upon arrival.
SOUTH AFRICA CHILD ENTRY REQUIREMENTS: Parents travelling with children under 18 will be required
to produce an unabridged birth certificate for ALL travelling children. Should just one parent travel with a
child, consent in the form of an affidavit from the other parent is required in addition to an unabridged
birth certificate. Guardians travelling with children must produce an affidavit from the parents giving
permission for the children to travel as well as carrying each child’s unabridged birth certificate.
BOTSWANA CHILD ENTRY REQUIREMENTS: As of 1 October 2016, ALL minors travelling through any of
Botswana border posts are required to produce the following: valid passport, certified copies of
unabridged birth certificate. In the event that one parent is not present, the missing parent’s affidavit
consenting to such travel. However, an affidavit will not be required if the fathers name does not appear
on the child’s birth certificate. Please note: The South African immigration requirements for minors more
than covers the Botswana requirements, so if passengers are transiting through South Africa, they will
already have the necessary documentation.
G. HAND LUGGAGE ALLOWANCE
This is regulated by the Airports Company South Africa (ACSA) who control all SA airports. The following
allowances are strictly applied; economy class passengers one bag plus one slim line laptop bag, business/
first-class passengers two bags plus one slim line laptop bag. Slim line laptop bags must be of a size and
thickness specifically designed to carry a laptop and charger. Bags capable of carrying other items such as
documents and clothes are not permitted. Bags must not exceed 56cm (22in) x 36cm (14in) x 23cm (9in)
(total dimensions of 115cm or 45in) or weigh more than 7kg (15lbs) per bag. Handbags are not considered
to be hand luggage. In East Africa bags, must not exceed 15 Kg per person. More specific information on
luggage is provided with each specific trip. On all safari trips bags must be soft on all sides (duffle bags).
H. LIABILITY DISCLAIMER & UNCONDITIONAL RELEASE
WITHOUT LIMITING THE ASSUMPTION OF THE RISK SET FORTH ABOVE, you acknowledge that travel
carries with it certain risks, including risks which may not be foreseeable, and that you are responsible for
your own health and safety AT ALL TIMES.
You agree to hold harmless and release D-Side Travel from any direct, indirect, punitive, incidental, special
or consequential damages arising out of any acts, errors, omissions, representations, warranties, breaches
or negligence by D-Side Travel, its officers, directors, agents, or employees.
By arranging travel to particular countries and regions, D-Side Travel does not represent or warrant that
travel to such areas is advisable or safe, and is not liable for damages or losses that may result from travel
to such destinations. Risks such as political instability, crime, terrorism, war, disease, wild animal attacks,
and natural disasters are not confined to particular countries or regions, and may impact travelers
anywhere in the world. As such, travelers are advised to seek reliable and timely health and safety
information prior to traveling, including from the U.S. State Department’s travel website
(http://travel.state.gov/), and the Centers for Disease Control travel website (www.cdc.gov/travel/).
Travel is strictly at the risk of the passenger and the passenger assumes the risk of such dangers and DSide
Travel accepts no responsibility or liability for passenger safety of any kind or type, whatsoever.
Visitors to remote areas should be prepared for unexpected changes in the itinerary and should arrive
with a flexible attitude toward their visit and the understanding that it is impossible to control, foresee,
or guarantee all aspects of the tour. In the event of non-provision, abridgment, modification, or
substitution of services, beyond the control of and through no fault of D-Side Travel, refund is limited to
the amount returned by the overseas suppliers less administrative costs.
By arranging for particular activities, D-Side Travel does not represent or warrant that such activities are
advisable or safe and is not liable for damages or losses that may result from such activities. There are
many inherent risks in adventure travel, which can lead to illness, injury, or even death. These risks are
increased by the fact that these trips take place in remote locations, far from medical facilities. Guest
assumes all such risks associated with participating in these trips.
The airlines, hotels and other suppliers providing travel, lodging, or other services are not agents or
employees of D-Side Travel. D-Side Travel in no way owns or operates the vehicles or facilities to be used
during the trip. D-Side Travel is not liable for the acts, errors, omissions, representations, warranties,
breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or
other damages or expenses resulting there from. This liability falls on the supplier. D-Side Travel has no
liability in the event of any delay, cancellation, overbooking, strike, terrorism, force majeure or other
causes beyond their direct control, and they have no responsibility for any additional expenses, omissions,
delays, re-routing or acts of any government or authority.
Many suppliers are likely to impose their own Terms and Conditions, which are separate and apart from
these D-Side Travel Terms and Conditions. Please read these additional terms and conditions carefully. In
particular, if you have purchased an airfare, please ensure you read the full terms and conditions of
carriage issued by the airline, which can be found on the airline’s website.
Some hotel suppliers may require you to present a credit card or cash deposit upon check-in to cover
additional expenses incurred during your stay. Such deposit is unrelated to any payment received by us
for your hotel booking.
You acknowledge that some third-party providers offering certain services and/or activities may require
you to sign their liability waiver prior to participating in the service and/or activity they offer. You
understand that any violation of any such supplier’s rules and restrictions may result in cancellation of
your reservation(s), in your being denied access to the applicable services, in your forfeiting any monies
paid for such reservation(s), and/or in our debiting your account for any costs we incur as a result of such
I. Travel Insurance
As sometimes the unexpected does occur, it is required that the guest carries adequate comprehensive
travel and medical insurance to cover themselves, as well as any dependents/travelling companions for
the duration of their trip. It is compulsory that all travelers take out comprehensive travel insurance
covering personal effects, accident, medical and emergency travel expenses, cancellation and curtailment.
D-Side travel will not be held liable for any claims resulting as a result of lack of/ or inadequate travel
insurance coverage. By signing these terms and conditions you acknowledge that you have purchased or
intend to purchase suitable and adequate coverage and hold D-Side Travel harmless.
Department of Health regulations in South Africa, Botswana, Mozambique, Zambia, Zimbabwe, Kenya
require all visitors arriving from or having passed through countries with risk of yellow fever transmission
and for travelers having transited more than 12 hours through the airport of a country with risk to be in
possession of a valid Yellow Fever Vaccination Certificate. Individuals that cannot be vaccinated due to
contra-indications must be in possession of a waiver letter that clearly states the reason why this is the
case. Please refer to the WHO website, a doctor or travel clinic for a list of the countries that require
proof of vaccination.
Following full payment, your final travel documents will be forwarded to you at a maximum of two weeks
prior to your departure from the U.S.
L. This is a Binding and Complete Contract
This is a binding and complete contract, executed when you sign that you accept these Terms and
Conditions. D-Side Travel expressly disclaims any warranties, representations, or statements contrary to
the express terms of these Terms and Conditions. This contract is governed by the federal laws of the
United States of America and by the laws of the State of Georgia. Any claim or dispute between the parties
to this contract shall be the subject of ARBITRATION.
THE PARTIES AGREE THAT SUCH ARBITRATION SHALL BE CONDUCTED IN ATLANTA, GEORGIA IN
ACCORDANCE WITH THE COMMERCIAL DISPUTE RULES OF THE AMERICAN ARBITRATION ASSOCIATION
(“AAA”). THE PARTIES TO THIS CONTRACT SHALL SPLIT THE COSTS OF SUCH ARBITRATION EQUALLY,
REGARDLESS OF OUTCOME. THERE SHALL BE ONE ARBITRATOR. IF THE PARTIES CANNOT AGREE ON THE
IDENTITY OF SUCH ARBITRATOR, THEN AAA SHALL DETERMINE THE IDENTITY OF THE ARBITRATOR.
Consumer Disclosure Notice
Please read the Terms & Conditions carefully, as your deposit and payment for a trip constitutes consent
to all conditions and general information contained in this brochure.
I understand that the penalties, terms and conditions as described above apply to all payments that I
make to D-Side Travel
I ……………………. hereby release and discharge D-Side Travel and its agents and employees from and
against any and all liability arising from my (and any other members traveling with me) participation in
this trip. I agree that this release will be legally binding upon myself, my heirs, successors and legal
representatives; it being my intention to fully assume all risk of travel and to release D-Side Travel from
any and all liabilities to the maximum permitted by the law.
